New forms of employment will appear in Ukrainian legislation, which will bypass the guarantees of workers' rights.



In particular, employers will be able to hire employees by concluding an "employment contract with unfixed working hours" and an "employment contract under the conditions of a simplified regime for regulating labor relations."

Corresponding innovations are contained in the draft laws adopted this week, writes Socportal.

On July 18, 286 people's deputies voted for the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on the Regulation of Labor Relations with Unfixed Working Hours" No. 5161. It introduces into the legal field an employment contract with non-fixed working hours, which does not establish a specific work performance time. The employee's obligation to perform work arises only when the employer provides it. If the employee is never called to work during the month, he will receive compensation equivalent to the payment for 32 hours worked. The minimum notice period is not defined, so that it will be established in each employment contract. The scope of such employment contracts is limited to 10% of the staff.

On July 19, 259 parliamentarians adopted the draft Law of Ukraine "On Amendments to Certain Legislative Acts on Simplifying the Regulation of Labor Relations in the Field of Small and Medium-Sized Businesses and Reducing the Administrative Burden on Business Activity" No. 5371. It introduces a simplified regime for regulating labor relations with employees employed at enterprises with several employees up to 250 people or employees whose wages exceed eight times the minimum wage. The employer can terminate a "simplified" employment contract without reason with the provision of compensation of at least half of the minimum salary (the payment amount depends on the employee's seniority). The law and such an employment contract will determine the grounds for involvement in overtime and nighttime work on holidays, weekends, and non-working days.

Both drafts contain provisions that allow additional grounds for dismissal in the employment above contracts.

If the President of Ukraine signs these acts, a stable salary, a predictable schedule, and protection against dismissal may become a luxury. Since the end of March, legislators have constantly been making new and new concessions to employers, but so far, this has not brought improvements in the labor market. If, as of March 1, six unemployed persons applied for one vacancy, then as of July 1, 13 unemployed persons competed for one vacancy. The new laws will encourage employers to shift all risks to workers instead of innovating in production. Job seekers will be forced to agree to new employment contracts, which will make them more vulnerable, says Vitaly Dudin, head of the board of the Social Movement NGO.

Parliament planned to adopt similar initiatives last year. Then they were harshly criticized by the International Labor Organization under the UN. At one time, the social media site published a video with the position of her representative.
